Social Security Disability Appeals - If denied at the Hearing level, some claimants may file an appeal with the Appeals Council in Virginia. Others who wish to appeal the decision must proceed to the next level of adjudication in their claims. (See Federal District Court Level). This appeal must be filed within 60 days of the ALJ's decision. The Appeals Council is the highest level of Administrative Review. Also, one must remember that this is usually a very time-consuming process. The chances of a favorable decision from the Appeals Council are not good.
Social Security Disability Claim Award - When a client of Shaw Management Corporation is awarded a favorable decision, our accounting department will review the decision and make an estimate of the past-due benefits due to the client and their dependents. It can take several weeks to receive the first check from SSA. If a client qualifies for Supplemental Security Income (SSI) Disability benefits, Social Security will contact the client to update the claim folder.
Social Security Disability Federal Appeal - If an SMC client is denied at the Appeals Council Level, or if the claim comes directly from the ALJ, one of our attorneys will review the case to determine if we should pursue benefits through the court system. If it is determined that the case merits such, the claim is filed.
Social Security Disability Claims Hearing - Should the ALJ require an oral hearing, one of our experienced Social Security attorney or non-attorney Hearing Representatives will prepare the case for presentation to the ALJ and will travel to the hearing site to represent our client. Our Social Security Disability claims win rate at this level is among the highest in the nation.
Social Security Disability Claims Application - An application for benefits is filed by completing many forms and submitting proof of age and citizenship to the Social Security Administration. The claim is sent to a State Agency which makes a determination of whether the claimant's conditions are severe enough to meet the definition of disability.
